Welcome to SmartAirRemote (the "App"), an air conditioner remote control service provided by Wuhan Yufa Elephant Law Consulting Co., Ltd. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the App.
Notice: We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App or on our website. Your continued use of the App after updates constitutes acceptance of the revised Terms.
The App helps you discover, connect to, and control air conditioners and related smart devices. Features may include local network discovery, cloud device sync, infrared remote control, temperature and mode adjustment, and optional membership benefits. Specific capabilities depend on your device model, connection method, and subscription status. We may add, change, or discontinue features at our discretion.
You agree not to misuse the App. Prohibited activities include, but are not limited to:
Remote control commands are sent at your direction. You are responsible for safe and appropriate use of your air conditioning equipment, including energy use, room occupancy, and compliance with manufacturer instructions. We do not guarantee that every command will succeed due to network conditions, device compatibility, firmware, or environmental factors.
Certain features require a paid membership. All transactions are processed by Apple In-App Purchase and are subject to Apple's terms and policies. Prices are displayed in the App and may change. By completing a purchase, you agree to pay the stated amount. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period in your Apple ID settings. Refunds are handled according to Apple's policy and applicable law.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant uninterrupted, error-free, or secure operation, or that the App will meet your requirements or control every device model. To the fullest extent permitted by law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Wuhan Yufa Elephant Law Consulting Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, device malfunction, discomfort, property damage, or increased energy costs. Our total liability for any claim shall not exceed the amount you paid us through the App (if any) in the twelve (12) months preceding the claim. Nothing in this section limits liability that cannot be excluded by law.
You may stop using the App and uninstall it at any time. We may suspend or terminate your access without prior notice if you breach these Terms, if required by law, or if we discontinue the App. Upon termination, provisions regarding intellectual property, disclaimers, limitation of liability, and governing law will survive.
These Terms shall be governed by the laws of the People's Republic of China, without regard to conflict-of-law principles. Any dispute shall first be addressed through good-faith negotiation. If unresolved, the dispute shall be submitted to the courts with jurisdiction in Wuhan, Hubei Province, China, unless mandatory consumer protection rules in your jurisdiction require otherwise.
